Why Let Facts Get in the Way? A Letter from Swan Valley Nyungah Community...

Since the SVN community's eviction by the Gallop government, Perth Indymedia has been the most prolific media outlet for the dissemination of the plight of the Swan Valley Nyungah crew. We've had half a dozen features on the issue.

Anyway, following recent mainstream media focus, including the West Australian Newspaper and the ABC on the plight of Indigenous folks in Halls Creek in WA's north west

- the families and Community Members of the Swan Valley Nyungah Community, say they are deeply concerned and disgusted with the treatment of the People of Halls Creek -

I must first make it clear that I am mostly reading from a statement here and do NOT even pretend to be speaking on behalf of Aboriginal peoples. These are Bella Bropho's words. I have condensed them here for brevity's sake...

"We have seen it all before - says Bella - we were, and still are, the victims of a beat-up campaign by The West Australian Newspaper.

The hysteria whipped up by the media and used by the Government forced us out of our homes and Land.

Our beautiful Community, which we designed, built and ran and which was a haven for those the Government ignored, has been left to rot by the Gallop and Carpenter Governments. We were dispossessed and left homeless by a Government who relied on lies and unfounded rumour for their decisions...

We, like the People of Halls Creek, have been denied procedural fairness and this can only result in more suffering for all of us..."

Bella Bropho writes that:

"No white community is neglected in this way. This Government has proved time and time again that they have no understanding of our Culture and do not want to take the advice of our experts who are our Elders and Law Men and Law Women.

It is apparent that the Government wants the Aboriginal People to fade away. They are out to destroy Aboriginal communities. They have treated our People like dirt. There has never been proper consultation with us. Every policy is developed to destroy our Aboriginal Culture and the Aboriginal People.

Government policies are policies of assimilation into the white society and are developed to make us invisible, to destroy our Culture and our Sacredness. There is a constant destruction of our Land and Waterways.

This attack against the Indigenous Nations of Australia started with invasion and is still going on in the 21st Century. Nothing has changed. Our children are still being taken away.

The Land of Aboriginal People is still being taken away. Our Sacred Holy Places are destroyed. Open your eyes, Australia. This is happening in front of you. Reality is staring you in the face and you refuse to see.

We, the First People, are still being lied about, being made homeless and are still being persecuted.

Aboriginal People are fighting daily for our human rights and our survival.

This is never recognized by white people, the Government or the media. In spite of this, we survive. Our People and Culture should be celebrated. Because of the strength of our Culture and Religion we are able to survive against odds that would destroy others."

==Scott Parkin court challenge begins==

Lawyers for US peace activist Scott Parkin appeared briefly in the Federal Court on Tuesday 4 April to defend his right to know why he was detained and and deported in September last year.

Lawyers for ASIO had sought to strike out Mr Parkin's application on the basis that there is no legal provision for the review of ASIO security assessments.

Mr Parkin's lawyers agreed to an adjournment to enable them to clarify that that the security assessment is being challenged on natural justice grounds.

Friends of Scott Parkin say, "The Federal Court action had broader implications than Mr Parkin's case. This is the issue of whether people are entitled to have these decisions made without any opportunity to scrutinise them."

The group say "Our civil liberties are seriously under threat in the name of the war on terror."

Mr Parkin has not been given reason for his treatment by the Australian Government.

Attorney General Phillip Ruddock should immediately release the substance of the security assessment to Mr Parkin's lawyers.

Scott was locked up in solitary confinement, smuggled out of the country under guard and handed a $12,700 bill courtesy of the Australian Government. Eight months later, he remains completely baffled as to what he is supposed to have done to warrant this treatment. It is outrageous and deeply disturbing that Scott has been forced to take court action to find out exactly what he is accused of, let alone defend himself from those accusations.

National security legislation passed in 2004 could give Mr Ruddock the power to prevent evidence relating to Mr Parkin's security assessment from being heard in an open court.

==Cops call for immediate Villawood detention centre closure==

Villawood Detainees exposed to asbestos: The NSW Police Association has called for the closure of Sydney's Villawood detention centre. They have warned officers not to set foot on the site following the detection of asbestos.

The immigration department has confirmed asbestos was discovered, but says detainees will not be evacuated.

Police Association president Bob Pritchard said they were particularly concerned that the centre would remain open over Easter, when a large contingent of Refugee Rights advocates will arrive for the V06 Refugee Rights Convergence.

"The federal government has a moral and legal responsibility to the health and safety of detainees and others working at the detention centre," Mr Pritchard said.

"The federal government cannot let this issue drift to Easter, where hundred of police could be exposed. It must shut the centre immediately and safely remove the asbestos."

The Department of Immigration and Multicultural Affairs confirmed detainees had been exposed to asbestos.

A department spokesmouth said the 255 detainees at the centre would not be evacuated from the centre because the current asbestos levels were considered low risk.

==Howard says no no no to Nuclear Power Rancid Yellow Emu Vomit==

April 5, 2006 - Despite Federal Parliament's industry and resources committee desire to set up an inquiry into the merits of Nuclear Power - it seems the Howard Government has refused a request for an inquiry into nuclear power in Australia, claiming nuclear energy must be a decision for "generations to come"

However, the request has been rejected by Federal Resources Minister Ian Macfarlane. "You don't have to be a rocket scientist to work out that our abundance of clean coal makes it very, very hard for domestic nuclear power to stack up economically," said Mr MacFarlane.

Despite the obvious and absolutely wrong notion that Coal can be "clean", Mr Macfarlane said domestic nuclear energy was a "decision reserved specifically for the people of Australia in generations to come".

The rejection of the inquiry follows the signing of a nuclear agreement with China to deal billions of dollars worth of Aussie uranium. Treasurer Peter Costello has warned that Canberra may override some states dissent and allow uranium to be mined and exported.

The notion that Australian uranium will only be used for peaceful purposes is factually wrong.

Environmental groups have raised strong objections about Australia's export agreement with China, arguing that the any "safeguards" with China contained a "huge hole". Once it goes into the conversion facility, it just disappears off the safeguards radar...

Rancid Yellow Emu Vomit
The Adnyamathanha people of the rocky country in the northern Flinders Ranges in South Australia (SA) tell a story of rancid yellow Emu vomit in particular pockets across the eastern side of their country.

==Attempts by a uranium miner to censor an anti-nuclear website fail==

A Darwin activist says attempts by a uranium miner to censor an anti-nuclear website have failed.
Mr Justin Tutty describes the website: compass-resources.info as “anti-corporate satire”

The contentious website has a similar name and appearance to the official Compass site. However, in place of their broker reports and announcements to the stock exchange is featured information about the environmental threats posed by plans for renewed activities around the abandoned Rum Jungle Uranium Mine.

Two weeks ago, the website was temporarily brought down when Compass Resources contacted the host, threatening legal action.

“It was disappointing that the previous host was so easily intimidated, but we had no trouble finding one who is committed to free speech” said Mr Tutty.

Mr Tutty admits that the site remains vulnerable to a court order in the U.S.

“At the end of the day, Compass Resources, with all their financial backing, may have the power to censor some forms of media” said Mr Tutty. “But this information, about radioactive mining waste, local and regional water impacts, and the broader issues of a new uranium mine, cannot be contained.”

==No surprises - Australia should welcome more fleeing West Papuans==
Get ready for more. More West Papuans are fleeing their homeland because they face persecution and injustice they face in their homeland at the hands of the violent and torturous Indonesian authorities.

The Howard Government should not be at all surprised to learn that more Papuans have come to Australian shores seeking asylum. A union activist, his wife and their four children are believed to be camping on an uninhabited island in Australia's north after being dropped off by a fishing boat.

The Australian Customs Service is trying to confirm reports that a family of six landed on Bamboo Island in the Torres Strait on Sunday after a voyage from the Papuan coastal town of Merauke.

More Papuans are fleeing their homeland because they face persecution. "The Government should not be surprised that more asylum seekers are arriving from West Papua," said Greens Senator Kerry Nettle.

"West Papuans are fleeing because of persecution and injustice they face in their homeland at the hands of Indonesian authorities. The situation has deteriorated since the first boatload of asylum seekers left West Papua."

She said Australia's strained relationship with Indonesia must not affect the assessment of their asylum claims. "These latest asylum seekers arrive in the midst of diplomatic difficulties between Australia and Indonesia," she said.

"These problems must have no bearing on the need to hear their asylum claims fairly. Mr Howard and Mr Downer must not continue to utter diplomatic niceties when the facts on the ground in West Papua contradict their words. They should show leadership and raise the rights of the West Papuans with Indonesia and the United Nations."

The Reverend Yus Mawengkang, a Catholic priest in Merauke in West Papua, says the latest newcomers are Paulus Samkakai, a labor union leader, his wife and four children. The priest said that two fishermen took the family to Bamboo Island, which is part of Australia, in a motorboat.





==NUS Slams Howard’s Attack on Same-Sex Couples and ACT Democracy==
The National Union of Students has condemned the Howard government’s moves to overturn the Civil Unions Bill which would extend legal recognition to same-sex couples.

“As the first majority government in the ACT’s history, Chief Minister Stanhope has a clear mandate to implement this Bill” NUS National Queer Officer Norman Jacka said.

“The federal government has always claimed in the past that lesbian and gay issues were matters for the states and territories to legislate on, now we have a territory government that is doing just that and Howard and Ruddock have signalled that they will move to thwart the democratic will of the people of the ACT” he said.

With a recent Newspoll survey finding that 52.5% of Australians were in favour of equal rights for same-sex couples and just 36.6% were opposed, people are sick of John Howard playing wedge politics and attacking minorities. This just shows how out of step he is with the public on this issue.

NUS calls on people who care about equality to write to or call their MPs and Senators and let them know that they support equality for same-sex couples and won’t stand for Howard’s attacks on lesbian and gay Australians.

Which group of Australians are barred from using the Medicare safety net, getting concessions on prescription drugs?

Who are not given tax breaks, government superannuation, veterans entitle ments, workers compensation and judicial pensions...?

Clue: In 1999 the UNHCR ruled that the Australian Government had breached the International Covenant on Civil and Political Rights?

Despite more than a decade of law reforms, same-sex couples are denied many of the entitlements that heterosexuals take for granted, says the president of the Human Rights and Equal Opportunity Commission, John von Doussa, QC.

In an effort to document, and eventually overturn Australia's discriminatory laws - HREOC have opened an inquiry into the financial and work-related entitlements and benefits denied to gay and lesbian couples.

Mr von Doussa says: "It is quite incredible that in this day and age Australia has laws which include a definition of 'partner' - that explicitly states that a person must be of the opposite sex to be entitled to basic financial benefits like tax concessions, and the Medicare safety net," he said. "This simply does not reflect reality - it never did."

A case to the United Nations Human Rights Committee in 1999 over the Veterans' Review Board ruled out allowing a gay man to apply for a pension. The UNHCR found the Veterans' Entitlement Act limited the definition of couple to heterosexual married or de facto partners.

The UN committee ruled that the Australian Government had breached the International Covenant on Civil and Political Rights.

As a signatory to the covenant, the Government was obliged to amend the law and ensure similar violations did not occur in other legislation, the committee said.

==Let them eat [yellow]cake: National Protests at Uranium Sales to China==

Across Australia today community, environment and peace groups held yellowcake stalls to protest the signing of a deal to sell uranium to China.

“Selling uranium is a crumby idea at the best of times,” said Louise Morris, spokesperson for Beyond Nuclear Initiative, Melbourne. “but we could really get our fingers burnt with this most recent deal.”

China is a nuclear weapons state with around 400 nuclear warheads. For them to have access to a reliable source of cheap and plentiful uranium is just the icing on the cake.

“The half baked assurances that Australian uranium won’t go into nuclear weapons programs are laughable,” said Nat Wasley, spokesperson for Arid Lands Environment Centre- Beyond Nuclear Initiative, Alice Springs

“China loses hundreds of workers to industrial and mining accidents each year, and sees untold environmental damage as a result of these too,” stated Scott Ludlam, spokesperson for Anti-Nuclear Alliance of Western Australia. “Adding yellowcake into the mix is just a recipe for disaster.”

Ms Morris concluded by saying, “The major political parties are playing packet mix politics to the mining lobby – just add water to get the instant policy you want.

“But the Australian community have shown time and again that they are willing to turn up the heat to stop nuclear projects, and we will do so again.”

Groups in Alice Springs, Melbourne and Perth tested their recipes today, with Canberra preparing for a "pie on ya face" gallery on Friday and Brisbane keeping their concoctions a secret until Sunday.

“While the China National Nuclear Corporation busies itself converting Australian uranium into Weapons of Mass Destruction, all that is required under the terms of the agreement is that at some, unspecified part of the nuclear fuel cycle, an equivalent amount of nuclear material is subject to safeguards. Verifying that such a transfer has occurred is easier said than done. As the government’s documents also acknowledge, IAEA inspections of China's facilities are carried out on a "selective" basis.”

"With proposed exports of 10,000 tonnes of uranium per year, the Chinese regime could build 2,000 nuclear weapons per year using Australian uranium - without even breaching the terms of the disgraceful agreement struck between the Howard government and the Chinese regime.

==IR challenge means West Aussies lose power to the Feds==

If the States fail in their High Court bid to block the Federal Government's IR laws, WA would lose its power to ban poker machines, uranium mining, extended shopping hours and even daylight saving, says Constitutional law expert Greg Craven.

He says this is really the last stand for the States. If they lose this case basically it means that the balance of power is no longer written in the Constitution, it's just whatever the Commonwealth says it is on any particular day.

Professor Craven from Curtin says if the High Court endorsed the Federal use of corporations law to grab control of industrial relations, the floodgates would open and Canberra would charge into any field where corporations operated.

Universities, hospitals, private schools, ports, charities and sporting and cultural clubs; corporate government entities like Western Power and Water Corporation were all incorporated and therefore could end up regulated by the Feds in Canberra if the High Court challenge failed.

Federal Treasurer Peter Costello has already foreshadowed the Commonwealth's use of corporations law to override WA's ban on uranium mining.

"It may be argued that, under our trade and commerce power and it may be argued under our external affairs power, that the Commonwealth has the ability to facilitate the trade and commerce of uranium and the export of uranium," Mr Costello said.

==Perth Detention Centre convergence Easter 2006==

In solidarity with the international weekend of action on refugee rights, and in particular with the Villawood convergence, all Perth refugee rights activists who aren't going to Villawood are encouraged to spend the weekend (or at least some of it) at the Perth Airport Immigration Detention Centre, Brearley Avenue, near the domestic terminal.

So far the proposal is to meet at midday on the Friday and camp through till the Sunday night. We will have banner making material on site and a list of the major flights in and out.

All cars arriving at the terminal have to stop near the centre to get into the car park, so when a big flight is coming or going there's lots of opportunity for leafleting.

==Solar-thermal power touted as energy solution==

Australian scientists have developed a new way of producing electricity, which could provide all of Australia's electricity needs in 2020.

It has been developed by mixing solar energy, heat and natural gas. Two hundred mirrors track the sun, and focus the sun's rays towards a tower. The heat can reach temperatures of more than 1000 degrees Celsius, producing 500 kilowatts of power. This is then mixed with natural gas and water to produce a renewable energy.

Wes Stein from the CSIRO says the new development could provide for Australia's future energy needs.

"It would only require about 50 kilometres by 50 kilometres in the centre of Australia somewhere to provide all of Australia's electricity needs in 2020," he said. "That's not very much of Australia."

A $5.3 million National Solar Energy Centre (NSEC) was opened last week. The Federal Enviro Minister said: "The NSEC will be a showcase for solar thermal technologies and play a key role in CSIRO’s ongoing research into efficient, low emission energy generation," Senator Campbell says.

The NSEC, based at CSIRO’s Energy Centre in Newcastle, is the only multi-collector facility of its type in Australia and home to the largest high-concentration solar array in the Southern Hemisphere.

==WA gay lobby calls on Carpenter to enact Civil Unions==

Western Australia's Gay and Lesbian Equality Group (GALE), has called on Premier Alan Carpenter to introduce a civil union registration scheme for both opposite and same-sex couples.

The call comes in the wake of the Howard Government saying it may override the enactment of civil unions in the ACT. The ACT Labor Government earlier this week announced it would enact civil union laws in its jurisdiction, and which would allow same-sex couples from any state or territory to register their relationship.

GALE spokeswoman Kelly Pilgrim-Byrne, said that WA had fallen behind other states and territories and was overlooking the global trend in this area of human rights law.

"The significant gay and lesbian law reforms of 2001 were a huge step forward, but more needs to be done specifically to protect the rights and responsibilities of those couples who are unmarried or who cannot marry," Ms Pilgrim-Bryne said.

"The Howard Government can override the laws of a territory, but not a state. The WA Government should set up a civil union registration scheme that can be used by residents of any state or territory."

Under Australian Federal law same-sex couples are prohibited from marriage under the Marriage Act 1961.

"While the State Government has enacted excellent laws to outlaw discrimination against same-sex couples, gay and lesbian people still encounter the problem of trying to prove to authorities that they have a relationship."

"There is no administrative process, no registration office, no legal certificate to show that a gay or lesbian couple is legally, emotionally and financially interdependent."

"Certification is important when same-sex couples are required to prove their relationship status, for example, when applying for insurance, child custody, superannuation benefits, visa applications or during medical emergencies."

"Tasmania already has a system of partnership registration for gay and straight couples and the ACT will soon have civil unions."

"Labor Governments in Britain and New Zealand have both enacted civil unions, while the Netherlands, Spain, Canada, Belgium and South Africa all have full marriage rights. Regrettably, same-sex couples in WA have no such legal certification."

"Western Australians should not have to travel all the way to Canberra to arrange for a civil union, there should be the facility and the legal right to do that here in our state. Indeed, there would be a tourism gain to WA if a civil union registration scheme for all Australians was enacted here, Ms Pilgrim-Byrne said.

==Millions in new strike against jobs law in France==

More than 3-million people took part in protest demonstrations against a new youth labour law in France yesterday, organisers of the protests said, as negotiations on the scrapping of the measure were apparently set to begin. The turnout may have surpassed that of the March 28 protest against the First Job Contract (CPE).

Organisers said that about 700,000 people took part in the anti-CPE protest in Paris and 250,000 in Marseille. The massive turnout for a second week running may convince parliamentarians to give in to trade and student union demands for the CPE to be scrapped when negotiations between the two sides begin, perhaps as early as today.

The head of the parliamentary faction of the ruling UMP party, Bernard Accoyer, said yesterday he had sent letters to trade union leaders inviting them to take part in negotiations today “without prejudging the contents of the law” on the CPE.

CFDT union head Francois Chereque said union leaders had agreed on principle to meet with UMP representatives “on condition they agree to talk about repealing the CPE”. It was not clear if government negotiators would agree to that demand before drawing up another law to fight youth unemployment, which stands at about 23%, and double that in long-neglected suburban ghetto areas.

Perth Detention Centre convergence 12:01 PM
In solidarity with the international weekend of action on refugee rights, and in particular with the Villawood convergence, all Perth refugee rights activists who aren't going to Villawood are encouraged to spend the weekend (or at least some of it) at the Perth Airport Immigration Detention Centre, Brearley Avenue, near the domestic terminal. So far the proposal is to meet at midday on the Friday and camp through till the Sunday night. We will have banner making material on site and a list of the major flights in and out. All cars arriving at the terminal have to stop near the centre to get into the car park, so when a big flight is coming or going there's lots of opportunity for leafleting. We're going to take a punt on the weather holding and have one more activists picnic before the rains come. Same spot as before, the city corner of Hyde Park, corner of Glendower and William Streets. Bus routes 16 or 60 from the Bus Port, Barrack Street near the Terrace or Beaufort Street next to the Museum. A comfortable walk from Perth or City West train if you're reasonably fit. Please bring food and drink to share if you can. No sexism, no racism, no hierarchy. No agenda other than social contact amongst diverse activist communities. There has been talk of doing something indoors over the rainy season, possibly with some sort of philosophical discussion to kick it off, something a bit like Politics in the Pub, but without the Trots. If you have any ideas on this, talk to other people at the picnic about it all and we'll see what happens next... Phone 9371 3791
