Now we are writing to let you know the Federal Court Hearing of our Native Title Claim will begin at the Federal Court, 1 Victoria Avenue, Perth at 10.00am on TUESDAY 11 OCTOBER 2005. We first made our Claim in 1994.
The Court Hearing will go on in that building for Wednesday 12 October and Thursday, 13 October and then the Federal Court will travel around other areas of Nyungah Country for Nyungah Elders to give their evidence to the Court. (It will be in the Court Lists in the paper).
Our Spokesperson, our Elder, Robert Bropho, will give his evidence on the Lockridge Land at Pyrton, near Success Hill, near our Home - the Camps, running off Lord Street, at Eden Hill coming in the Pyrton entrance. Drive right in, eastwards as far as you can, right to the high point overlooking the River and the Hills and Bennett Brook coming in to the River, a very Sacred Area. This will be on WEDNESDAY 26 OCTOBER 2005 at 9am. Richard Wilkes, Greg Garlett, Kelvin Garlett will probably give their evidence on Thursday and Friday. William Warrell is giving his evidence in the Moora Area.

= UK: Mass Deportation of Immigrants Blockaded in Dublin. Arrests Ongoing
Tuesday, Oct. 18, 2005 - Immigration police seized several families across Ireland this morning (Tue Oct 18th) and brought them to Dublin for summary deportation. 3 vans go out with asylum seekers, all nigerian who will return to a life of hell. Here is an audio file from the steps of the garda national immigration bureau, speaking with rosana flynn from residents against racism, she tells us of early afternoon scuffles which led to 3 arrests, a serious incident with a nigerian friend of rosannas who was dragged out onto the streets, her shoes came off, she went unconcious, she was dragged up to the local police station, despite requests from people that she be taken to hospital
We waited outside until the last van came out, there were heavy handed tactics used by the gardai and mainstream journalists took numbers and said they witnessed gardai assaults, the woman has left her children here, she was held inside the bureau from before 2pm till she was taken out at 8pm, without any food or water given to her. people were on the phone to her and she was in a very distressed state

Taking back his position as Brooklyn's own controversial and conscious emcee, Mos Def addresses the hurricane disaster, racism, the president and Bono on "Katrina Clap." On the song, which uses the original beat from Juvenile's "Nolia Clap," Mos cries out to God to "save the streets" and each person to donate at least "$1" for relief efforts. Juvenile is from New Orleans and has lost much in this national tragedy.
He reserves most of his heat for President Bush who he says "shouldn't be the boss anymore" and echos Kanye's sentiments about the President's disdain for blacks saying "He got a policy for handling the n#@$s as trash."

- NZ: Weapons Conference: Tank Blockaded, 20 Arrested - Aotearoa Indymedia
Weapons Conference, Tank Blockaded: 20 Arrested - 19 Oct 2005: About 70 protesters in Wellington, including members of the Aotearoa Revolutionary Clown Army, took on Te Papa and a tank on Tuesday as part of protests against the New Zealand Defence Industry Association. The Te Papa entrance was blockaded for two and a half hours and a tank was stopped from leaving the area by a second blockade.
20 people in all were arrested, 7 of whom have been charged. The conference is host to an international assortium of weapons manufacturers including Halliburton, General Dynamics and Lockheed Martin, as well as a range of New Zealand companies...
The action, which was organised by Peace Action Wellington, involved a large sit-in/blockade in front of Te Papa which lasted for about two and a half hours, and also a blockade in front of an armoured vehicle. Twenty people in all were arrested, from charges ranging from obstruction, trespass and assault of police officers.
The action began in Civic Square where the Aoteaora Revolutionary Clown Army (ARCA) and others gathered. They made their way along the waterfront and in to the Te Papa forecourt. The march bypassed the fencing designed to pen them in and went around the side. Police scrambled to intercept them and, in response, the march broke into a quick run towards the front entrance.
Many protesters were tackled to the ground but enough got through to start the sit-in and, after a few scuffles, everyone was able to make it to the front. Chants of "No arms at our place", "Arms trade, Death trade!" and "War mongers, Out! Out! Out!" went up as protesters linked arms and blocked the front entrance.
The blockade was maintained for about two and a half hours. The clowns made persistent fun of both the conference attendees and the police (as well as the mayor!) by lining up with them, marching around behind them, as well as riding bikes and throwing water balloons.
A certain "pro-capitalist" contingent holding placards such as "Fuck the 3rd world" and "Capitalism is wonderful" were attacked and dealt to in appropriate clown fashion. Hundreds of leaflets were also handed out to a receptive public.
As protesters were considering leaving after about two and a half hours, one protester was quite randomly grabbed from behind, arrested for trespass and dragged away to an awaiting paddy wagon. Protesters went head to head with the police and another was arrested for trespass, which resulted in the arrest of a third who was dragged into the scuffle.
Another protester was badly injured, and later had to be treated for concussion, after police punched and knocked her to the concrete. A tense confrontation followed with the police before the clown army decided to break off and march away, keeping the focus on the conference.
Immediately after, the army attempted to get an armoured vehicle out from Te Papa and onto the road, to which protesters responded by laying down in front and linking up. The tank came to a halt, backed up and was locked in behind a gate and a police line. Police were far more brutal this time as protesters were picked off one by one.
A police contingent marched to and fro from the paddy wagon to the blockade as they ripped individual protesters away, some receiving quite painful treatment, and were arrested. The original 17 people dwindled down to a hardy three, who refused to leave and were picked off finally, after about 30 minutes since the blockade began.
In all twenty were arrested, most discharged later with breach of the peace, but seven have had charges held against them including trespass, assault and obstruction.
- Sedition Laws Target Peaceful Civil Disobedience
An analysis of the wording of the proposed anti terrorist laws has revealed that 'to bring the Sovereign into hatred or contempt' could land you 7 years in jail. The changes to the Sedition Act will encompass a wide range of activities that deliberately target activists and even critics of the government and constitution. Specifically it appears that any form of non violent civil disobedience will now be considered unlawful, while any activity that urges 'disaffection against' the 'Constitution' or the 'Government of the Commonwealth' will also attract a jail sentence…
The new Sedition Laws in the anti-terror bills clearly target people who call for acts of non-violent civil disobedience. Under the laws there is no defence for calling for change to any law by anything other than lawful means. Penalty is up to seven years jail.
In an extremely dangerous development for free speech that is yet to be picked up by the mainstream press, the new anti-terror bills clearly outlaw calls for non-violent civil disobedience.
The changes to the Sedition Act which are Part of Schedule 7 of the draft laws (p75) outline the following
"In this section:
seditious intention means an intention to effect any of the following purposes:
(a) to bring the Sovereign into hatred or contempt;
(b) to urge disaffection against the following:
(i) the Constitution;
(ii) the Government of the Commonwealth;
(iii) either House of the Parliament;
(c) to urge another person to attempt, otherwise than by lawful means, to procure a change to any matter established by law in the Commonwealth;
(d) to promote feelings of ill-will or hostility between different groups so as to threaten the peace, order and good government of the Commonwealth.
I draw your attention to section c) which clearly targets not just peaceful civil disobedience but anyone who calls for civil disobedience. By definition the civil disobidence is involves the attempt to change a law through non-lawful means. So shortly when you put up a post on Indymedia calling for blockading in Gippsland, being part of a non-legally sanctioned picket, a sit in against uranium mining etc you could face 7 years gaol.
But wait you say - the government says that it is offering an "acting in good faith" defence against sedition charges. Read on:
(p79 of law)
80.3 Defence for Acts done in Good Faith
(1) Sections 80.1 and 80.2 do not apply to a person who:
(c) urges in good faith another person to attempt to lawfully procure a change to any matter established by law in the Commonwealth, a State, a Territory or another country;
Note the law specifically only offers a defence to people who act in good faith to urge others LAWFULLY procure a change to the law. So the law on sedition specifically offers no defence to those who call for changes to law to happen outside the law ie this obviously includes peaceful non-violent civil disobedience.
So the new sedition law makes it a serious criminal offence to even call for an act of peaceful civil disobedience.
The sedition law also only offers a defence to those involved in union actions if
"e) does anything in good faith in connection with an industrial dispute or an industrial matter."
What the hell does this mean. Who decides what industrial actions "are in good faith". Its totally open to interpretation of the courts who we know can sometimes come down very hard on militant union action. So now calling for a picket if it is outside the ever narrowing legal framework of legal disputes will be a crime facing up to seven years gaol.
The mainstream press are not even covering this aspect of the laws - but the deportation of a U.S. activist Scott Parkin who was calling for you guessed it - peaceful non-violent civil disobedience as a "national security threat" shows who the government are gunning for.
These Sedition Laws are a drastic attack on free speech and are worthy of a fascist police state. I defy someone to explain to me how these aspects of the Sedition Laws can be justified as part of the so-called "War on Terror". How will these changes to the sedition laws make us safer? Rather it is obvious that these laws are designed to give the state the power it desires to crush dissent.
I call on everyone to read the laws for themselves as there is some really scary stuff in them and hope to see you at the rally on Saturday October 22nd State Parliament 1 PM.

• The laws that control how genetically engineered foods, crops and organisms have FAILED to prevent contamination of GE free farms, even in States where the growing of GE is prohibited
• Under the Gene Technology Act, big GE corporations are not held liable when genetic engineering contaminates the environment – it’s the farmers and public who will pay.
• Our Gene Technology Regulator and Food Standards authority don’t require that GE companies have the onus of demonstrating that their GE products are safe and don’t require rigorous independent scientific testing of claims made by the GE corporations.

Demand to know
• Why Australian law does not require proof that seed imports labelled as such actually are GE-free?
• Why Australian law doesn’t require the owner and marketer of patented GE seeds to be held legally responsible for their product?
• Why the Australian Quarantine Service does not screen or test any imported seeds, even from high-risk countries such as the United States?
• Why are state based moratoria on the commercial growing of GE food crops being actively undermined by Federal agencies?
• Why does the Act impose no onus of proof on the patent holder to demonstrate that its product is safe for the environment or human consumption?

- BHP Roxby - The Seven Deadly sins
Think BHP. Think Ok Tedi. Ouch! BHP owns the Roxby uranium/copper mine and wants to make it the biggest uranium mine in the world
The Seven Deadly Sins:
1. The Roxby mine uses over 30 million litres of water per day, drawn from the Great Artesian Basin free of charge. The precious Mound Springs have been adversely effected and in some cases destroyed. For the planned expansion, BHP wants to draw over 100 million litres of water per day from the Great Artesian Basin.
2. BHP enjoys completely unjustifiable legal privileges - the Roxby Indenture Act which overrides the SA Environment Protection Act, the Water Resources Act, the Aboriginal Heritage Act and even provides exemptions from the Freedom of Information Act.
3. The radioactive waste tailings dump at Roxby now amounts to 60 million tonnes and is growing at a rate of 10 million tonnes annually with no long-term plans for its management. In nuclear power reactors Roxby uranium ends up as high-level nuclear waste, for which no long-term solution exists.
4. Aboriginal communities have been subject to outrageous 'divide and rule' tactics http://geocities.com/olympicdam/articles.html
5. Nuclear weapons proliferation. It is impossible to be certain that Australian uranium will not end up in nuclear weapons. As a young Mike Rann noted: "Again and again, it has been demonstrated here and overseas that when problems over safeguards prove difficult, commercial considerations will come first." Uranium from Roxby is sold to Nuclear Weapons States - such as the USA and France - which have no intention of fulfilling their disarmament obligations under the Nuclear Non-Proliferation Treaty. Uranium sales to Japan (and the subsequent plutonium stockpiling) are feeding regional tensions and proliferation risks in North East Asia. Now there are plans to sell uranium to China - a repressive military state in violation of its NPT disarmament obligations.
6. The Roxby mine is the single largest electricity user in SA and the single largest greenhouse gas polluter in SA (about 8% of the SA total). So much for the claims about 'greenhouse friendly' nuclear power!
7. In 2003, spills totalled over 650,000 litres. In previous years there were other spills and leaks and massive fires. Oh, and that 5 trillion litre leak from the tailings dam but we won't mention that!
